IS LICENSED NOT SOLD.

COMMUNITY EDITION EVALUATION TERMS

The Software may be obtained as try-before-you-buy software under the

Community Edition Evaluation terms of this EULA. These terms permit

unlimited use of the Community Edition in its unmodified binary form.

However, the Community Edition does not provide the full suite of features

available in other editions and includes other restrictions. The purpose

of the Community Edition is to encourage you and others to try the Software

before you buy it. The Community Edition terms do not apply to Retail

copies of the Software (see below).

There is no fee for downloading or otherwise obtaining the Community

Edition Software for the purpose of evaluation or for general use of

the Community Edition. However, copies of the Software obtained this

way do not include a Registration Key.

Purchasing a Registration Key for the Software entitles you to use the full

suite of features available for the program. The Registration Key must

be located in a text file named "license_key.txt" and located in the

home directory for the program.

RETAIL PURCHASE

The Software may also be obtained through retail purchase. Retail copies

of the Software include a Registration Key which is located in a file

named "license_key.txt" in the directory in which the application is

installed. If the Registration Key is not provided in the

"license_key.txt" file, the application will limit the amount of data

that may be entered into or read by the application and certain other

features may be missing or otherwise restricted.

BENEFITS OF REGISTRATION

* All reminders will cease once you have entered your Registration Key,

leaving you free to fully enjoy the program without annoying reminders.

* The application will not limit the amount of data that may be entered

or imported.

HOW TO PURCHASE A REGISTRATION KEY

The Community Edition may be converted to a registered version by placing

a valid "license_key.txt" file into the applications installation directory.

To puurchase a Registration Key visit www.mammothsoftware.com and follow

the purchasing instructions. Payment is accepted online by credit card.

Upon confirmation of payment, you will receive a registration code by email.

The registration code should be placed in a text file named "license_key.txt"

located in the installation directory of the application.

GRANT OF LICENSE

The purchase price entitles you to a single Registration Key for the Software.

Upon purchase of a Registration Key, Mammoth Software, LLC grants you a

non-exclusive, non-transferable (except as provided below) license to

use the Software according to the terms of the EULA. Prior to purchase

of a Registration Key, you may use the software only as provided by the

Community Edition Evaluation terms of this EULA.

If you have licensed the Software for business use, you may install and

register a single, primary copy of the Software. As a business user,

you may use the same Registration Key for an additional copy of the

Software on a portable computer with the restriction that both copies

may not be in use simultaneously. Business use means any use of the

Software by a business or for the purpose of furthering a business,

whether or not a charge is made in connection with the use or resulting images.

If you have licensed the Software for your personal use, you may install

and register multiple copies using a single Registration Key on computers

you use at your residence. As a personal user, you may use the same

Registration Key for additional copies of the Software on portable

computers that are used by you and your immediate family.

You may copy and redistribute unregistered Community Edition Evaluation

copies of the Software as long as you do not charge a fee for it; do not

modify the software, documentation or license statement in any way and

do not bundle it with another system.

You may not make the Registered Software available to third parties, with

or without a fee, in connection with a service bureau, application service

provider, or similar service, nor permit anyone else to do so. You may not

rent, lease or lend registered copies of the Software to third parties. You

may not redistribute your registration key.

You agree not to take steps such as altering, decompiling, reverse

assembling or reverse compiling to derive the source code or "look and feel"

equivalent(s) of the software

TITLE

As between the parties, title, ownership rights, and intellectual property

rights in and to the Software, and any copies or portions thereof, shall

remain in Mammoth Software and its suppliers or licensors. The Software is

protected by the copyright laws of the United States and international

copyright treaties. Title, ownership rights, and intellectual property rights

in and to any software, data, information, text, pictures, images, or other

content ("Content") accessed through the Software or otherwise is the property

of the applicable owner and may be protected by applicable copyright or other

law. This License gives you no rights, title, or interest to Content (including

without limitation Content that you create using the Software).

DISCLAIMER OF WARRANTY.

THE SOFTWARE, AND ANY SERVICES THAT YOU RECEIVE FROM MAMMOTH SOFTWARE ARE PROVIDED

"AS IS", WITHOUT WARRANTY OF ANY KIND. MAMMOTH SOFTWARE HEREBY DISCLAIMS ALL

EXPRESS OR IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION WARRANTIES OF

MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS AGREEMENT.

SOME STATES DO NOT ALLOW EXCLUSIONS OF AN IMPLIED WARRANTY, SO THIS DISCLAIMER

MAY NOT APPLY TO YOU AND YOU MAY HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE

TO STATE OR BY JURISDICTION.

LIMITATION OF LIABILITY.

You assume the entire risk as to the quality and performance of the Software.

Mammoth Software assumes no liability for the cost of any service or repair

if the Software is defective.

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, STRICT

LIABILITY, OR OTHERWISE, SHALL MAMMOTH SOFTWARE OR ITS LICENSORS, SUPPLIERS

OR RESELLERS BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL,

INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT

LIMITATION, DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, WORK STOPPAGE,

COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER DAMAGES

OR LOSSES. IN NO EVENT WILL MAMMOTH SOFTWARE BE LIABLE FOR ANY DAMAGES,

EVEN IF MAMMOTH SOFTWARE SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF

SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.

TERMINATION.

Mammoth Software may, at its sole discretion, terminate this Agreement,

the license granted herein, and your right to use or access the Software

at any time. On termination, you must destroy all copies of the Software.

EXPORT CONTROLS.

You shall comply with all export laws and restrictions and regulations of

the Department of Commerce, the United States Department of Treasury Office

of Foreign Assets Control ("OFAC"), or other United States or foreign agency

or authority, and not export, or allow the export or re-export of the Software

in violation of any such restrictions, laws or regulations (including, without

limitation, export or re-export to destinations prohibited either in Country

Groups Q, S, W, Y or Z country specified in the then current Supplement No.

1 to Section 770 of the U.S. Export Administration Regulations (or any

successor supplement or regulations), or the OFAC regulations found at 31

C.F.R. 500 et seq.). By installing or using the Software, you are agreeing

to the foregoing and you are representing and warranting that you are not

located in, under the control of, or a national or resident of any

restricted country or on any such list.

MISCELLANEOUS.

This Agreement represents the complete agreement concerning this license

between the parties and supersedes all prior agreements and representations

between them. It may be amended only by a writing executed by both parties.

If any provision of this Agreement is held to be unenforceable for any reason,

such provision shall be reformed only to the extent necessary to make it

enforceable. This Agreement shall be governed by and construed under Maryland

law as such law applies to agreements between Maryland residents entered

into and to be performed within Maryland.

U.S. GOVERNMENT RESTRICTED RIGHTS.

Use, duplication or disclosure by the Government is subject to restrictions

set forth in subparagraphs (a) through (d) of the Commercial Computer-Restricted

Rights clause at FAR 52.227-19 when applicable, or in subparagraph (c) (1) (ii)

of the Rights in Technical Data and Computer Software clause in DFARS 252.227-7013,

and in similar clauses in the NASA FAR Supplement.
